About State Legislative Assembly:

  • It is a Legislative body, this house is known as the Lower house (Vidhan Sabha) of the State Legislative assembly just as the Lok Sabha in the Union legislature.
  • 28 states and 3 union territories have legislative assembly and 6 states also have the State Legislative Council (Vidhan Parishad) or the Upper House.
  • The  Member of the Legislative Assembly (MLA) is directly elected by Voting Process and to Serve 5-year terms by Single Member constituencies. The Constitution of India states that a State Legislative Assembly must have No more than 500 members and not less than 60 members.
  • For the qualification of Legislative assembly, the member must be a citizen of India and at least 25 years old, and must be registered on the Voters List of the state for which She or He is contesting an Election of that state.
  • No-Confidence Motion against the state Government can only be introduced in the State Legislative Assembly. If it is passed by a majority of the member's vote, then the Chief Minister and His or Her Council of Ministers must collectively resign from the post.
  • The Money Bill can only be introduced in the State Legislative Assembly, and In a bicameral legislature, it is sent to the State Legislative Council, where it can be kept for a maximum time of 14 days.
  • In matters related to Ordinary Bills, the will of State Legislative Assembly prevails and there is No provision of Joint sitting in the assembly. In such cases, the State Legislative Council can delay the Legislation by a maximum of 4 months (3 Months in the First visit and 1 month in the Second visit of the Bill).
  • The State Legislative Assembly has to Power to Create or Dismiss the State Legislative Council by Passing a Resolution to that effect by a majority of not less than Two-Thirds of the Members Present and Voting.
